JUSTICE VINOD KUMAR SINHA ORAL ORDER 30-08-2019 Petitioners seek bail in anticipation of their arrest in connection with Kumarkhand P.S. Case No. 23 of 2019 registered for the offences punishable under Sections 341, 323, 307, 379, 354, 504, 506 and 34 of the Indian Penal Code. Prosecution case is that accused persons, including the petitioners entered inside the house of the informant, assaulted her, taken away Rs.2 lac and ornaments along with other articles and there is also allegation that they tried to outrage her modesty and also other female members.

Submission of learned counsel for the petitioners is

Patna High Court CR. MISC. No.54522 of 2019(2) dt.30-08-2019 2/2 that there is land dispute between the parties and there is case and counter case.

Heard learned APP and perused the impugned order, from which it appears that opinion on some of the injuries is kept reserved and allegation is general in nature. In view of above facts and circumstances, let petitioners, in the event of arrest or surrender, be released on bail on furnishing bail bonds of Rs.25,000/- (Rupees twenty five thousand) each with two sureties of the like amount each to the satisfaction of the S.D.J.M., Madhejpura, in connection with Kumarkhand P.S. Case No. 23 of 2019, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. and further condition is that one of the bailors of the petitioners shall be a local person having sufficient immoveable property within the jurisdiction of the court concerned.
