The petitioner apprehends his arrest in a case registered under Section 420 and other sections of the Indian Penal Code.
The petitioner is not named in the F.I.R.
The informant, in sum and substance, alleged that she got 541 marks whereas Shashi Kumari got 540 marks. Both applied for appointment on the posts of Teacher in a Panchayat, but Shashi Kumari was appointed. Thereafter, the matter came up before this Court in Writ jurisdiction and ultimately, the informant was appointed as a Teacher.
It is submitted that the petitioner is not named in the F.I.R. and even during the course of investigation, nothing
Patna High Court Cr.Misc. No.34291 of 2014 (2) dt.12-02-2015 2/2 was found against the petitioner. The name of the petitioner figured in this case on mere suspicion in the supervision note. Considering the facts aforesaid, the above named petitioner, in the event of his arrest or surrender before the learned court below within a period of four weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Gopalganj, in connection with Gopalganj (Town) P.S. Case No.319 of 2013, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
