JUSTICE JITENDRA MOHAN SHARMA ORAL ORDER 25-05-2016 Heard learned counsel for the petitioner and learned A.P.P. representing the State.

The petitioner seeks bail in connection with Fatuha P.S. Case No. 558 of 2015 registered for the offences punishable under Sections 304(B), and 120(B)/34 of the Indian Penal Code. Priyanka Devi the daughter of the informant was married to Santosh Yadav in the year 2009 and allegedly, she was being tortured for non-fulfillment of demand of ornaments and vehicle by the husband and other in-laws including the petitioner and ultimately she was burnt to death.

Submission is of false implication and that the petitioner, being Nandoshi of the deceased, has got no concern

Patna High Court Cr.Misc. No.22544 of 2016 (2) dt.25-05-2016 with the family affairs of the deceased and her husband, he is residing at village Naraina, P.S. Fatuha, District Patna. The husband is already in custody and without any fault the petitioner is suffering in custody since 23.02.2016.

The learned A.P.P. fairly submits that the petitioner is Nandoshi.

In the facts and circumstances stated above, the petitioner, above named, is directed to be released on bail on execution of bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Ms. J. Jama, learned Judicial Magistrate, 1st Class, Patna City, Patna in connection with Fatuha P.S. Case No. 558 of 2015 subject to the conditions that one of the bailors must be near relative and another having sufficient immovable property within the territorial jurisdiction of the court concerned and the petitioner shall remain present on each and every date during trial and the default on two consecutive dates on his part without any reason shall disentitle the petitioner from privilege of bail.
