The petitioner is languishing in jail since 22.05.2017 in a case registered for offences punishable under Sections 8/20 (b) (ii) (c) N. D. P. S. Act.
The prosecution case as lodged by the police personnel is that during patrolling, they received information that Ganja is being sold in the shop of the petitioner and the police raided the shop and recovered 400 gram Ganja from the shop. It has been submitted by the learned counsel for the petitioner that she is innocent and aged lady of 69 years and the shop belongs to her son and she had brought meal for her son and at that juncture, she was apprehended by the police. Patna High Court Cr.Misc. No.29783 of 2017 (2) dt.04-07-2017 2/2 submitted that the petitioner has no criminal antecedent and nothing has been recovered from the conscious possession of the petitioner.
However, learned A.P.P. for the State opposes the prayer for bail.
Considering the facts and circumstance of the case and materials on record, let the petitioner above named, be released on bail on furnishing bail bond of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of learned Sessions Judge- cum- Special Judge, Khagaria in Spl. Case No. 06/2017 ( arising out of Morkahi P. S. Case No. 66/2017), subject to the conditions that the petitioner is directed to appear before the learned Court below on each and every date and failure to appear before the Court below on two consecutive dates without assigning any reason will entail cancellation of her bail bonds (Nilu Agrawal, J) Sudha/- U T
