Petitioner is apprehending his arrest in connection with Shahpur Patori P.S.Case No.310 of 2018 , registered for offences punishable under Sections 341, 323, 324, 379, 504, 506/34 of the Indian Penal Code and Section 27 of the Arms Act. Prosecution story is that the petitioner and other accused persons came to the house of the informant and the petitioner made indiscriminate firing and also assaulted the informant by the BUT portion of the rifle causing injury to her. Submission of the learned counsel for the petitioner is that the FIR itself shows that there is dispute with respect to passing of the drainage which was objected by the informant and for that the present case has been lodged and the
Patna High Court CR. MISC. No.52143 of 2019(2) dt.21-08-2019 2/2 impugned order disclosed that the learned Addl. Sessions Judge has perused the injury report and he has not mentioned as to whether the injury is grievous or not.

Having heard both sides and in view of the facts and circumstances, as stated above, let the petitioner, above named, in the event of arrest or surrender before the learned court below, be released on bail on furnishing bail bond of Rs.25,000/- (Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the learned ACJM IV, Samastipur in connection with Shahpur Patory P.S.Case No.310 of 2018, subject to conditions as laid down under Section 438
(2) of the Code of Criminal Procedure.
