2. The petitioner has preferred this application for grant of regular bail in connection with Basmatiya P.S. Case No. 23/2025 dated 24.04.2025 registered for the offence punishable u/ss 8(c) and 21(b) of the N.D.P.S. Act and Section 111 of the B.N.S.

3. As per the prosecution case, total 115 grams of brown sugar and Rs. 7700/- of Nepali currency were recovered from the house of the co-accused Shatrughan Chaupal.

4. Learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated in this case. The name of the petitioner has sprung up in the

No.55199 of 2025(2) dt.27-08-2025 2/3 confessional statement of the co-accused, Ravin Kumar Chaupal, who has been granted regular bail by this Court vide order dated 11.08.2025 passed in Cr. Misc. No. 51567 of 2025. The seized contraband is less than commercial quantity. Nothing has been recovered from the conscious possession of the petitioner. The petitioner has no concern with the alleged recovery. The petitioner has one criminal antecedent as stated in para 3 of the bail petition. The petitioner is in custody since 28.06.2025.

5. Learned A.P.P. for the State has vehemently opposed the bail petition of the petitioner.

Considering the aforesaid facts and circumstances of the case as well as the period of custody, the petitioner abovenamed, is directed to be enlarged on bail on furnishing bail-bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court concerned, Araria in connection with Basmatiya P.S. Case No. 23/2025, with a condition:- (i) The petitioner is directed to remain physically present before the learned Court below on each and every date, failing which on two consecutive dates without reasonable cause, the bail bonds of the petitioner are liable to be cancelled.
