JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 15-01-2015 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner is not named in the first information report but in course of investigation, the spy of the police expressed his suspicion regarding involvement of this petitioner and one coaccused Ranvir Kumar, who was subsequently arrested in Parsa Bigha P.S. Case No. 73 of 2011 and made his confessional statement stating the involvement of the petitioner in the alleged crime and it appears from perusal of the case diary that except the aforesaid material as well as criminal antecedent of the petitioner coupled with statement of some witnesses recorded at Paras.212, 213, 214 etc, there is nothing against the petitioner. So far as statement of witnesses recorded at paras 212, 213 214 etc of the

Patna High Court Cr.Misc. No.33713 of 2014 (3) dt.15-01-2015 2/2 case diary, it appears that the aforesaid witnesses have expressed only suspicion against the petitioner.

Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Jehanabad in connection with Parasbigha P.S.Case No. 26 of 2011.
