The petitioner is in custody in connection with Purnea Sadar P.S. Case No. 135 of 2015 for the offences under Sections 409 and 420 of the Indian Penal Code. From perusal of the written complaint of the Branch Manager, Gulabbag Branch, Purnea of Central Co-operative Bank, it appears that the petitioner, who was working as contractual employee in the Bank, has allegedly misappropriated Rs. 30,000/- of one Abu Thahir having A/c No. 1033 deposited Rs. 10,000/- in his account on 23.3.2013 and Sumitra Devi having A/c No. 1158 deposited Rs. 20,000/- in her account on 26.2.2013 as the
Patna High Court Cr.Misc. No.24633 of 2017 (4) dt.20-07-2017 2/2 petitioner has issued deposit slips to them but not deposited the aforesaid amount in their Accounts. There is further allegation that he was involved in the case of withdrawal of KCC loan amounts of Rs. 10,00,000/- in the name of a dead persons. Today, learned counsel for the petitioner has filed a supplementary affidavit annexing affidavits sworn by Sumitra Devi and Abu Tahir regarding receipt of payment of Rs. 20,000/- and Rs. 10,000/- which was subject matter of complaint filed by the Branch Manager of the Bank.
Considering the aforesaid facts and circumstances, I am inclined to enlarge the petitioner, above named, on bail on furnishing bail bond of Rs. 50,000/- (fifty thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Purnea, or the successor Court in connection with Purnea Sadar P.S. Case No. 135 of 2015, subject to the condition that the petitioner will extend full cooperation in conclusion of the trial and will not, in any manner, tamper with the evidence and influence the witnesses.
