This application for anticipatory bail arises out of Maheshkhunt P.S. Case No. 42 of 2019, disclosing the offence under Section 307 and other allied Sections of the Indian Penal Code.

In respect of an occurrence, which is said to have taken place on the same day and almost at the same time, two FIRs have been registered including the present one. Another FIR has been registered as Maheshkhunt P.S. Case No. 41 of 2019 by the wife of a co-accused. The said FIR has also been brought on record by way of Annexure-2 to this application. On perusal of the two FIRs, it transpires that there is some dispute between the parties over a piece of land.

Patna High Court CR. MISC. No.53668 of 2019(2) dt.28-08-2019 2/2 Learned counsel appearing on behalf of the petitioner has submitted that both the sides have received injuries. Considering the nature of dispute leading to the alleged occurrence, this application is allowed. Let the petitioner, above-named, in the event of his arrest/surrender within six weeks from today in the court below, be released on bail on furnishing bail bonds of Rs. 10,000/-(ten thousand), with two sureties of the like amount, each to the satisfaction of learned J.M. 1st Class, Khagaria in Maheshkhunt P.S. Case No. 42 of 2019, subject to the condition as laid down under Section 438(2) of the Code of Criminal Procedure.

This is subject to the condition that the petitioner shall present himself before the Police/ Court, as the case may be, as and when required and in the event of failure on his part to appear before the court on two consecutive occasions, his bail bonds shall be liable to be cancelled.
