The petitioner seeks bail in anticipation of his arrest in connection with Laxmipur P.S. Case No. 188 of 2017 dated 06.09.2017 instituted for the offences under Sections 341, 323, 354, 379, 504, 506 and 34 of the Indian Penal Code.
The son of the petitioner is alleged to have entered the house of the informant and attempted to outrage her modesty. Later, the petitioner is also said to have lent support to his son by quarreling with the informant and other family members.
Learned counsel for the petitioner has submitted that the petitioner as well as the informant share a common courtyard and are directly related to
Patna High Court Cr.Misc. No.32842 of 2018(2) dt.29-06-2018 2/2 each other. The dispute arose because of scuffle between the children of two houses and the petitioners because of that have been made accused in this case. Regard being had to the facts that the petitioner as well as the informant share a common courtyard and the genesis of the dispute lay elsewhere, the petitioner above named is directed to be released on bail, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, on his furnishing bail bonds in the sum of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate-IIIrd, Jamui in connection with Laxmipur P.S. Case No. 188 of 2017, subject to the conditions as laid down under Section 438(2) Cr.P.C.
