Petitioner apprehends his arrest in connection with Bind P.S. Case No.65 of 2019 for the offence punishable under Sections 341, 323, 307, 379, 504, 506, 34 of the Indian Penal Code.
The allegation against the petitioner is that the petitioner along with other co-accused persons assaulted the informant, his wife and two sons causing them injury near head. Learned counsel appearing for the petitioner submits that both the parties are agnates and there is case and counter case inasmuch as side of the petitioner has also lodged Complaint Case No.586 (C) of 2019 for the same incident.

Learned counsel for the petitioner further submits that from perusal of Annexure 2 series, it appears that the injuries caused to the informant, his wife and other two sons are simple in nature.
After having heard learned counsel for the petitioner as well as learned counsel appearing on behalf of the State and taking into consideration the fact that both the parties are agnates and there is case and counter case and injury caused to the side of prosecution are simple in nature, as such, I am inclined to grant anticipatory bail to the petitioner. Accordingly, the petitioner, above named, is directed to surrender before the learned Court below within a period of four weeks from today and in the event of surrender by him, he shall be released on anticipatory bail by the Court below upon furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M.-IV, Nalanda at Bihar Sharif, subject to the condition as mentioned under Section 438 (2) of Cr.P.C.
