JUSTICE ASHUTOSH KUMAR ORAL ORDER 03-07-2018 Mr. Kamal Deo Sharma, learned counsel for the petitioners seeks permission to withdraw this petition with respect to petitioner No. 8/Ravindra Singh, since he has been arrested by the police.
Permission is accorded.
Accordingly, the present petition with respect to petitioner No. 8 stands dismissed as having become infructuous.
The petitioner Nos. 1 to 7 and 9 to 14 seek bail in anticipation of their arrest in connection with Koransarai P.S. Case No. 26 of 2018, dated 31.03.2018, instituted for the offences punishable under Sections 147, 148, 149, 323, 324, 307, 504, 379 and 506 of the Indian Penal Code. The petitioners and others are said to have assaulted the informant, his brother and some other persons. There appears to be a counter case also. The cause of occurrence is sad to be dispute over a drain. Considering the futility of litigation, the parties have decided to bury the hatchet and live peacefully as good neighbours. The injuries are also not in consonance with the allegations levelled in the F.I.R.
Regarding being had to the aforesaid facts as also
Patna High Court Cr.Misc. No.33316 of 2018 (2) dt.03-07-2018 3/3 that the petitioners do not have any criminal antecedent, this Court is inclined to enlarge them on anticipatory bail. Let petitioner Nos. 1 to 7 and 9 to 14, above named, in the event of their arrest or surrender before the learned Court below within a period of four weeks from today, be released on bail on their furnishing bail bonds in the sum of Rs. 10,000/- (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Buxar in connection with Koransarai P.S. Case No. 26 of 2018, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. (Ashutosh Kumar, J) Praveen-II/- U T
