Heard learned counsel for the petitioner and learned A.P.P. for the State, Sri Chandra Bhushan Prasad. 2.

The instant anticipatory bail application has already been dismissed as withdrawn with respect to Petitioner No. 2 (Navin Ravidas @ Navin Kumar) vide order dated 20-8-2025. 2.

The petitioner apprehends his arrest in a case registered for the offences punishable under Sections 137(2) and 87 of the Bharatiya Nyaya Sanhita.

The Investigating Officer of the case, in compliance of the order dated 11-11-2025, is present in the Court.

Learned counsel for the petitioner submits that petitioner is a person with clean antecedent and the informant alleges that on 23-12-2024 his daughter went out of the house and thereafter went missing, further earlier on 1-12-2024 Sahil had kidnapped his daughter for which Sirdalla PS Case No. 441 of 2024 was instituted and the victim was later found, it is next alleged that accused persons including the petitioner has again kidnapped his daughter.

Learned counsel for the petitioner submits that petitioner has been falsely implicated in the instant case by the informant. It is next submitted that the victim came back and her statement was recorded under Section 183 BNSS, wherein she has supported the case of the prosecution, but then has not alleged anything specific against the petitioner. It is also submitted that the statement of the victim under Section 183 BNSS has been recorded under parental pressure. 6.

Learned A.P.P. for the State opposes the prayer for anticipatory bail of the petitioner, but then is not in a position to rebut the submission of the learned counsel appearing on behalf of the petitioner that no specific allegation is alleged against the petitioner and the victim has come back.

Considering the submissions made by the learned

No.53735 of 2025(5) dt.17-11-2025 3/3 counsel for the petitioner, the petitioner No. 1, above-named, in the event of his arrest or surrender before the learned trial court within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned trial court where the case is pending/successor court in connection with Sirdalla P.S. Case No. 473 of 2024, subject to the conditions as laid down under Section 482 (2) of the BNSS.

The personal appearance of the Investigating Officer of the case is dispensed with.
