The petitioners seek bail in anticipation of their arrest in connection with Alauli P.S. Case No. 33 of 2018 dated 04.02.2018 instituted for the offences under Sections 147, 148, 341, 323, 325, 307 and 504 of the Indian Penal Code.

The petitioners are said to have entered the house of the informant and thereafter behaved in an indecent manner and also assaulted many members of the family.

Learned counsel for the petitioners has submitted that an absolutely false case has been instituted at the instance of the informant. Petitioner no.

Patna High Court Cr.Misc. No.33467 of 2018(2) dt.03-07-2018 2/2 1 had earlier filed a case against the informant and other family members vide Alauli P.S. Case No. 34 of 2018. During the course of investigation, it has been argued, it came to light that because of prior dispute relating to land, the occurrence had taken place in which both sides have assaulted each other. The injuries suffered by the informant and others are stated to be simple in nature.

No doubt some kind of occurrence had taken place but considering the fact that the petitioners belong to the same stock of family and stay practically under the same roof, they are directed to be released on bail, in the event of their arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, on their furnishing bail bonds in the sum of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Khagaria in connection with Alauli P.S. Case No. 33 of 2018, subject to the conditions as laid down under Section 438(2) Cr.P.C.
