The petitioners seek bail in anticipation of their arrest in connection with Banama Itahari (O.P.) Salkhua P.S. Case No. 122/2017 dated 12.06.2017 instituted for the offences under Sections 147, 148, 149, 341, 323, 324, 325, 379, 307 and 504 of the Indian Penal Code.

The petitioners and others are alleged to have assaulted the informant and other members of his family and also committed theft of certain personal belongings.

Learned counsel for the petitioners has submitted that there is a counter version of the occurrence also vide Salkhua P.S. Case No. 121/2017. In the aforesaid case, the petitioners have been injured. Their injury reports have been brought on record vide

Patna High Court Cr.Misc. No.33866 of 2018 (2) dt.05-07-2018 2/2 Annexures 3 and 4 of the petition. There are spate litigations between the parties because of land dispute between them. Considering the aforesaid facts as also taking into account that the petitioners do not have any criminal antecedents, they are directed to be released on bail, in the event of their surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, on their furnishing bond in the sum of Rs. 10,000/- (Ten Thousand), with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Saharsa in connection with Salkhua P.S. Case No. 122/2017, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
