1. Heard learned counsel for the parties.

2. The petitioner has preferred this application for grant of regular bail in connection with Supaul Nadi P.S. Case no.32 of 2023 registered under sections 302 and 309 of the Indian Penal Code.

3. As per the prosecution case, the informant states that as a result of some dispute in conversation on telephone between her daughter-in-law (petitioner herein) and her son who lives in Punjab for earning his livelihood, her daughter-in-law consumed poison and also forced her grand daughter to consume poison. Further she started cutting herself with a hasua and also inflicted injury on her grandson. As a result of the actions of her daughter-in-law, the informant's grand daughter died while the daughter-in-law (petitioner herein) and the

4. Learned counsel for the petitioner submits that as per the allegations in the F.I.R, the occurrence took place in the heat of the moment over some dispute between the husband and wife. No criminal offence can be made against the petitioner who happens to be the mother of the deceased. The petitioner is in custody since 12.4.2023 and has no criminal antecedent.

Having heard learned counsel for the parties and taking into consideration the nature of allegation in the FIR, the petitioner being in custody since 12.4.2023 and charge-sheet having been submitted in the case, the petitioner is directed to be enlarged on bail in connection with Supaul Nadi P.S. Case no.32 of 2023 on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial MagistrateI, Supaul.
