2. In view of the explanation furnished by the learned counsel appearing on behalf of the petitioners, the defect pointed out by the office is hereby ignored.

3. Petitioners are apprehending their arrest in a case registered for the offences punishable under Sections 191(2), 191(3), 115(2), 118(1), 109(1), 74 and 352 of the B.N.S.

4. Learned counsel appearing on behalf of the petitioners submits that petitioners are persons with clean

It is further submitted that from perusal of the allegation as alleged in the FIR, it would manifest that the family of the informant was going to a temple on the occasion of marriage of her daughter when ten accused persons intercepted them and assaulted the family members, on account of which they suffered injuries and the injured were referred to PMCH for better treatment. Learned counsel appearing on behalf of the petitioners further submits that the petitioners have falsely been implicated in the case by the informant. It is also submitted that from perusal of the allegation as alleged in the FIR, it would manifest that the allegation of assault is general and omnibus in nature. It is also submitted that the FIR does not even remotely disclose the reason for the occurrence. It is next submitted that petitioners will not abscond rather will cooperate in the investigation to prove their innocence.

5. Learned A.P.P. for the State opposes the prayer for anticipatory bail of the petitioners.

Considering the submissions made by the learned counsel for the petitioners and taking into consideration the fact that petitioners are persons with clean antecedent, let petitioners, above-named, in the event of their arrest or surrender before the learned trial court within a period of six weeks from today, be

No.58629 of 2025(2) dt.02-09-2025 3/3 released on anticipatory bail on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned trial court where the case is pending/Successor Court in connection with Barbigha P.S. Case No. 104 of 2025, subject to the conditions as laid down under Section 482 (2) of the B.N.S.S.

7. However, it is made clear that the petitioners will cooperate in the investigation and if the I.O. of the case files an application bringing to the notice of the learned trial court that petitioners are not co-operating in the investigation, in that event, the learned trial court shall be at liberty to cancel the bail bonds of the petitioners.
