In this case, the petitioner is seeking bail in connection with Surajgarha P.S. Case No. 12 of 2016 for offence under Sections 394 & 307 of the Indian Penal Code and Section 27 of the Arms Act.

As per allegation, the Informant is a hawker selling Saree to different villages. A person from backside gave a fire arm injury to the Informant and later on the Informant claimed that he can identify the accused person and gave details and features of the accused persons whereupon the police started searching the accused persons and, from the farm house of one Manoj Singh, the petitioner and others were found with liquor and cigarette. On the

Patna High Court Cr.Misc. No.23806 of 2016 (2) dt.31-05-2016 basis of the features given by the Informant, the petitioner was arrested and recovery has been made of the looted materials. In that view of the matter, this Court is not inclined to grant bail to the petitioner.

Accordingly, the prayer for bail of the petitioner, namely, Fantush Chaudhary is rejected.

However, liberty is given to the petitioner to renew his prayer for bail after nine months of the judicial custody. (Shivaji Pandey, J) Rishi/- U T
