JUSTICE ASHWANI KUMAR SINGH ORAL ORDER (Per: HONOURABLE THE CHIEF JUSTICE) 06-04-2015 This writ petition is filed by way of Public Interest Litigation alleging that though public land was encroached by unauthorized persons, the respondents did not take steps for removal thereof.
On receipt of notice, respondents filed a detailed counter affidavit. We noticed that encroachments were removed partially. Thereafter, we passed order on 23.03.2015 directing that in case encroachments are not removed as a whole, the 2nd
Patna High Court CWJC No.13868 of 2014 (5) dt.06-04-2015 2/2 respondent shall appear before this Court.
Today certain photographs are filed depicting that all encroachments have been removed.
Heard Sri Mukesh Kumar Jha, learned counsel for the petitioner and Sri S.Raza Ahmad, learned Additional Advocate General No.IX for the respondents.
The effort made by the petitioner, to get the encroachment on public rasta removed, materialized on the direction issued by this Court and action has been taken by the respondents.
Now that the encroachments are removed, we dispose of the writ petition directing that the respondents shall ensure that the cleared lands are not subjected to further encroachment.
The interlocutory application, if any, shall stand disposed of.
