The petitioner is in custody since 28.05.2015 in connection with Basantpur P.S. Case No. 189 of 2014 registered under Sections 326, 37 of the Indian Penal Code. 3.

Learned counsel for the petitioner submits that the petitioner is the father-in-law of the deceased lady and investigation reveals that she had herself committed suicide and initially, charge-sheet was submitted under Section 306 of the Indian Penal Code, however, the Court after differing with the police, has taken cognizance under Section 302 of the Indian Penal Code. Thereafter the petitioner is facing prosecution. 4.

Considering the period of custody of the petitioner,

Patna High Court Cr.Misc. No.24370 of 2016 (2) dt.01-06-2016 who is aged about 75 years and no definite role has been assigned to him and also the fact that there was some dispute with regard to the sale of the land for recovery of the money during the marriage ceremony, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand rupees only) with two sureties of the like amount each to the satisfaction of learned A.C.J.M. 10th , Siwan in connection with Basantpur P.S. Case No. 189 of 2014.
