Petitioner seeks regular bail in connection with Economic Offence P.S. Case No.10 of 2017 (Spl. N.D.P.S.) registered for the alleged offences under Sections 8/20 (b) (ii) (A), 25/29 of the N.D.P.S. Act.

As per the prosecution case, on the tip off police raided a Gumati located in front of St. Xeviers College, Digha and seized 290 gm. Ganja containing in 70 purias and apprehended the petitioner who is said to have tried to escape from the Gumti seeing the police force and recovered and seized one mobile from his possession.

It has been submitted by learned counsel for the petitioner that nothing incriminating article has been recovered

Patna High Court Cr.Misc. No.32535 of 2017 (02) dt.13-07-2017 2/2 from the conscious physical possession of the petitioner. He has no concern with the said Gumti and the seized Ganja. The seized Ganja is small in quantity. He has been languishing in jail custody since 04.06.2017.

In the facts and circumstances of the case, the petitioner above named is directed to be enlarged on bail on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand) with two sureties of like amount each to the satisfaction of learned Chief Judicial Magistrate, Patna in connection with Economic Offence P.S. Case No.10 of 2017.
