JUSTICE ASHUTOSH KUMAR ORAL ORDER 04-07-2018 Heard the learned counsel for the petitioners, informant and the State.
The petitioners seek bail in anticipation of their arrest in connection with Madanpur P.S. Case No. 56 of 2018, dated 03.03.2018, instituted for the offences punishable under Sections 341, 323, 379, 308, 504 and 506/34 of the Indian Penal Code.
Patna High Court Cr.Misc. No.33641 of 2018 (2) dt.04-07-2018 2/2 The petitioners are alleged to have come to the house of the informant and assaulted him, leading to injuries. Hence, the present case. From the F.I.R. itself, it can be deduced that there is pending land dispute between the parties.
Learned counsel for the petitioners has submitted that there is a partition dispute pending between the parties and hence the petitioners have been falsely implicated in this case. It has also been submitted that the injuries suffered by the informant are simple in nature.
Regard being had to the aforesaid facts as also that the petitioners above named do not have any criminal antecedents, they, in the event of their arrest or surrender before the learned Court below within a period of four weeks from today, are directed to be released on bail on their furnishing bail bonds in the sum of Rs. 10,000/- (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Aurangabad in connection with Madanpur P.S. Case No. 56 of 2018, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
