JUSTICE MOHIT KUMAR SHAH ORAL ORDER 13-03-2024 The present writ petition has been filed seeking the following relief:- "1)(i)For issuance of writ nature of certiorari for quashing the letter dated 30.09.2020 is issued under signature of Regional Manager, RBO II Sion by which rejected the request letter dated 01.07.2020 and upheld the order No.MZO-1/RBO/SION/HR/2018-19/585 dated
Patna High Court CWJC No.19451 of 2021(2) dt.13-03-2024 2/3 10.02.2020 without considering the case of the petitioner.
ii) For further quashing the order No. MZO1/RBO/SION/HR/ 2018-19/585 dated 10.02.2020 issued under signature of respondent Regional Manager, RBO II Sion by which held that petitioner failed to report for duty on before 10.02.2020, hence you have been voluntarily retired from the service on 10.02.2020 on the ground vide Memo No.
MZO-1/RBO/SION/HR/2018-19/585 dated 10.01.2020 sent to you at your last recorded address by registered A.D post calling upon you to report for duty within 30 days of that notice.
(iii) For issuance of direction to respondents for considering the case of petitioner for reinstate the service, on the ground, petitioner seeking extension of leave on medical emergency in his family by application dated 07.02.2020, same has not been considered rather issued a letter dated 10.02.2020 by which voluntarily retired from the service to the petitioner whenever petitioner was seeking medical leave."

At the outset, the learned counsel for the petitioner seeks not to press the present writ petition, however, seeks liberty on behalf of the
Patna High Court CWJC No.19451 of 2021(2) dt.13-03-2024 3/3 petitioner to avail such other alternative remedies as are otherwise available under the law, including that of approaching the Labour Court of competent jurisdiction. Liberty, so sought, is granted. 3.
The writ petition stands disposed of as not pressed.
