====================================================== CORAM: HONOURABLE MR. JUSTICE RAKESH KUMAR ORAL ORDER 27-06-2018 Heard Sri Harish Kumar, learned counsel for the petitioner . None appeared on behalf of the State. The sole petitioner, having clean antecedent, which fact has been stated in paragraph-3 of the petition, apprehending his arrest in Dighwara P.S. Case No.66 of 2018 registered for the offence under Section 30(a) of the Bihar Prohibition and Excise Act, 2016, has prayed for grant of bail, in the event of his arrest or surrender.

Learned counsel for the petitioner, by way of referring to the F.I.R. as well as seizure list, submits that in this case, from open Diara recovery of 30 liters of country-made liquor was shown and the informant, who is a police officer, on secret information, has arrayed the petitioner as F.I.R. named accused. It has been argued that the petitioner was not having

Besides hearing learned counsel for the parties, I have also perused the material on record including the seizure list. Considering the clean antecedent of the petitioner as well as the fact that nothing was recovered from the conscious possession of the petitioner, in the event of his arrest or surrender within a period of six weeks from today, let the petitioner, namely, Niranjan Manjhi be enlarged on bail on furnishing bail bond of Rs.10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned A.D.J. 6th , Chapra, Saran in connection with Dighwara P.S. Case No.66 of 2018, subject to conditions as laid down in Section 438(2) of the Code of Criminal Procedure.
