JUSTICE PRAKASH CHANDRA JAISWAL ORAL ORDER 20-07-2017 Heard learned counsel for the petitioners and learned APP for the State.

The petitioners seek bail in K. Hat (Marnga) P.S. Case No. 17 of 2017 registered under Section 380 of the Indian Penal Code.

Some unknown miscreants are said to have committed theft of laptop, mobile and purse from the house of the informant.

It is submitted by learned counsel for the petitioners that the petitioners are not named in the F.I.R. They have no concern with the aforesaid offence. They have been falsely implicated in this case on mere suspicion. Nothing incriminating article has been recovered from their conscious physical

Patna High Court Cr.Misc. No.33969 of 2017 (2) dt.20-07-2017 2/2 possession. There is nothing on the record indicating the complicity of the petitioners in the occurrence. Though on the basis of the confessional statement of petitioner no.2, a laptop and other articles are said to have been recovered from his in-laws house but the said articles are hailing to the petitioners. Regarding the said recovery, K. Nagar (Maranga) P.S. Case No. 62 of 2017 was registered against the petitioners and the petitioners are on bail in that case. Both the petitioners have been languishing in custody since 17.04.2017.

Considering the facts aforesaid, the above named petitioners are directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Purnea in connection with K. Hat (Marnga) P.S. Case No. 17 of 2017 (Prakash Chandra Jaiswal, J) Mishra/- U T
