The petitioner is languishing in custody in a case registered for the offences punishable under Sections 304B/34 of the Indian Penal Code.

The accusation is of killing the daughter of the informant for non-fulfillment of the dowry demand. It is submitted by learned counsel for the petitioner that petitioner is innocent and he has falsely been implicated in this case. The petitioner is husband of the deceased. There is general and omnibus allegation against the petitioner. There is no specific allegation against the petitioner. There is no eye witness to the

Patna High Court CR. MISC. No.61233 of 2023(3) dt.11-10-2023 2/2 occurrence. The petitioner had informed about the death of the victim to the informant. Moreover, the matter has been compromised between the parties and both parties have compromised the matter. The compromise petition is annexed as Annexure-P/2 to the petition. The petitioner is languishing in custody since 24.03.2023. In contra, learned A.P.P appearing on behalf of the State has vehemently opposed the prayer for bail of the petitioner.

Considering the facts aforesaid and the period under custody, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousands) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, 1st Class, Jamui in connection with Laxmipur P.S. Case No. 372 of 2022.
