JUSTICE RAKESH KUMAR ORAL ORDER 27-07-2016 Heard Sri Amit Kumar Rakesh, learned counsel for the petitioners and learned Addl. Public Prosecutor. Two petitioners, who are mother and sister of the husband of the deceased, have prayed for grant of anticipatory bail in Runnisaidpur P.S. Case no.80/2016 registered for the offence under Section 304(B)/34 of the Indian Penal Code. It was submitted by learned counsel for the petitioners that petitioners are innocent and have falsely been implicated in the present case. He further submits that the deceased had committed suicide.

Learned Addl. Public Prosecutor has opposed the prayer for grant of anticipatory bail. He submits that on perusal of

Patna High Court Cr.Misc. No.28410 of 2016 (2) dt.27-07-2016 2/2 the impugned order, it is evident that during investigation, witnesses have supported the case of the prosecution. He further submits that the marriage of the daughter of the informant was solemnized only two years back from the date of occurrence and also there are materials against the petitioners in the F.I.R.. Besides hearing learned counsel for the parties, I have also perused the materials available on record including the impugned order. I do not find any ground to grant privilege of anticipatory bail.
