The petitioner seeks bail in anticipation of his arrest in connection with Vaishali P.S. Case No. 328 of 2020, dated 01.10.2020, instituted for the offences under Sections 147, 148, 149, 341, 323, 324, 427, 504, 506 and 307 of the Indian Penal Code and Section 27 of the Arms Act. Later on, Section 302 I.P.C. has also been added.

No.65638 of 2021(3) dt.16-02-2022 2/2 Even though the petitioner is said to have fired but there is no corresponding injury to any one of the victims, but I am not inclined to grant him the privilege of anticipatory bail for the reason of the background facts where an attempt was made on the life of the members of the prosecution party.

The prayer for grant of anticipatory bail to the petitioner is, accordingly, rejected.

However, if he surrenders before the Court below and seeks bail, the Court below shall consider the case on its own merits, without being prejudiced by the fact that the present anticipatory bail application on his behalf has not been entertained by this Court.

The application stands dismissed.
