The petitioner is languishing in custody in a case registered for the offences punishable under Sections 341, 323, 504, 376 of the Indian Penal Code and Section 8 of the POCSO Act.

It is alleged against the petitioner that on promise to marry, he established physical relationship with the victim and continued the same for two years and thereafter denied to marry with the victim. It is submitted by learned counsel for the petitioner that petitioner is innocent and he has falsely

A supplementary affidavit has been filed to the effect that both sides have compromised the matter and now the petitioner is ready to solemnize marriage with the victim girl. The petitioner is languishing in custody since 20.05.2023.

Learned counsel appearing on behalf of the informant does not controvert this fact and submitted that both sides have compromised the matter.

Considering the facts aforesaid and the period under custody, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousands) with two sureties of the like amount each to the satisfaction of learned Exclusive Special Judge (POCSO)-cum-7th Additional District & Sessions Judge, Bhagalpur in connection with Kahalgaon (Ghogha) P.S. Case No. 253 of 2023.
