JUSTICE SANJAY KUMAR ORAL ORDER 20-07-2017 Heard The petitioner is in custody in connection with Balua Bazar (Lalit Gram) P.S.Case No.53 of 2016 registered for an offence under Sections 341, 323, 324, 307, 354A, 379, 504 and 506/34 of the IPC.

The allegation attributed to this petitioner is that he assaulted the son of the informant with farsa on his thigh. It is submitted that both the parties are neighbours residing at same place and for the occurrence of assault, there is also a counter case lodged by the wife of this petitioner. There is no repetition of blow which shows that there was no intention to commit murder. The petitioner is in custody since 18.05.2017. The doctor has found only one injury on right

Patna High Court Cr.Misc. No.32309 of 2017 (2) dt.20-07-2017 2/2 buttock which is not vital part of the body. There is no antecedent against this petitioner.

Learned APP opposed the submissions.

In the facts and circumstances, prayer is allowed. Let the above named petitioner be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of CJM, Supaul in connection with Balua Bazar (Lalit Gram) P.S.Case No.53 of 2016.
