JUSTICE SANJAY PRIYA ORAL ORDER 04-04-2017 Heard learned counsel for the petitioner and the State. The petitioner apprehends his arrest in Goraul P.S. Case No. 212 of 2014 instituted for the offence under Sections 354, 504, 506/34 of the Indian Penal Code and Sections 4/6 of Prevention of Corruption Act.
There is allegation against the petitioner that he established physical relationship with the informant aged about 14 years on the pretext of marrying her, on account of which, she became pregnant and, thereafter, petitioner refused to marry with her. Medical report has been enclosed as Annexure-2 wherein the age of victim girl has been determined to be 15-16 years. Although, the doctor has stated that she was habitual of sex act. Patna High Court Cr.Misc. No.23172 of 2016 (4) dt.04-04-2017 2/2 appears that the victim girl is minor and the petitioner established physical relationship with the girl on the pretext of marrying her. Considering the facts and circumstances of the case, this Court does not find it a fit case for grant of anticipatory bail to the petitioner.
The prayer for anticipatory bail of the petitioner stands rejected.
Petitioner is directed to surrender before the court below and make prayer for regular bail.
