The petitioner seeks bail in anticipation of his arrest in a case registered for the offences punishable under Sections 188 and 290 of the I.P.C. and Section 30(a) of the Excise Act. The learned counsel for the petitioner submits that the petitioner has antecedent of three cases and the allegation is of recovery of 05 litres of liquor from vacant land of petitioner. The learned counsel for the petitioner submits that petitioner has been falsely implicated in the present case. It is next submitted that police in mechanical manner has implicated the petitioner. It is also submitted that the land from where the alleged recovery is made belongs to one Suresh Mohan Thakur
Patna High Court CR. MISC. No.63418 of 2022(2) dt.06-12-2022 2/2 as would be evident from the report of the Circle Officer, Sabour dated 09.03.2022.
Learned A.P.P. opposes the bail application.
Considering the submissions made by the learned counsel for the petitioner, the petitioner, above-named, in the event of his arrest or surrender before the learned Court below within a period of six weeks, is directed to be released on bail on his furnishing bail-bonds in the sum of Rs. 20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of the learned Court below where the case is pending in connection with Industrial Area P. S. Case No.11 of 2022, subject to the conditions laid down under Section 438(2) of the Cr.P.C.
The application stands allowed.
