The petitioner is languishing in judicial custody since 04.06.2016 in a case registered for offences punishable under Sections 47 (a) of the Excise Amendment Act, 2016. The prosecution case is that on search by the Excise officials of General Compartment of a train, the petitioner was found to be having five liters country made liquor in a plastic bottle and accordingly, a seizure list was prepared. However, learned A.P.P. for the State opposes the prayer for bail.
Considering the facts and circumstances of the case and materials on record, let the petitioner, above named, be released on furnishing bail bonds of Rs. 10,000/- ( Rupees Ten thousand only) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Bhagalpur in connection with P.S.Case No. 144 of 2016.
