The petitioners apprehend their arrest in Barun P.S. case No. 85 of 2018 under Sections 379, 411/420/34 of the Indian Penal Code and section 4/40 of Bihar Mineral Rules and section 15 of Environment Protection Act.
The police intercepted many tractors loaded with sand and alleged that owner and driver of the tractors were committing theft of sand.
Learned counsel for the petitioners submits that petitioners are owner and driver of the tractor bearing registration no. BR24G-8251. The driver of the tractor was carrying sand on valid permit. Similarly situated many other accused persons have

Considering the facts aforesaid and the nature of allegation made against the petitioners and the fact that many other similarly situated accused persons have already been granted anticipatory bail, the petitioners, above named, in the event of their arrest or surrender before the learned court below within a period of four weeks from the date of receipt/ production of a copy of this order are directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Aurangabad, in connection with Barun P.S. case No. 85 of 2018, subject to conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
