The petitioner seeks bail in connection with Nimachandpura P.S. Case No. 112 of 2020 instituted for the offences under Section 30(a) of the Excise Act, 2016. Learned counsel for the petitioner submits that the petitioner is in custody since 17.08.2021, is a person with clean antecedent and charge-sheet has been submitted in the case. Learned counsel for the petitioner submits that allegation is of recovery of 2898.1 litres of liquor form a truck as detailed in the F.I.R. and one person Ranvir Kumar was arrested who disclosed that the liquor belongs to the petitioner. Learned counsel for the petitioner submits that the
Patna High Court CR. MISC. No.65604 of 2021(2) dt.11-02-2022 2/2 petitioner has been falsely implicated in the case, he was not arrested from the spot and his name transpired in the confessional statement of co-accused which has no evidentiary value in the eyes of law.
Learned A.P.P. for the State opposes the prayer for bail of the petitioner.
Considering the fact that the petitioner is in custody since 17.08.2021, charge-sheet has been submitted in the case, petitioner is a person with clean antecedent and his name transpired in the confessional statement of co-accuse, let the petitioner above named be released on bail on furnishing bail bond of Rs. 20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-II-cum-Special Judge, Excise Act, Begusarai in connection with Nimachandpura P.S. Case No. 112 of 2020.
