The petitioner is apprehending his arrest in connection with Paroo P.S.Case no.13 of 2017 registered for offences punishable under Sections 25(1-b), 26, 35, 25(1-A/25(1-AA) and 25(1-AAA) Arms Act, Section 3⁄4 of Explosive Substance Act and under Section 16, 17, 18, 18A, 19, 20 and 21 of U.A.P. Act. Petitioner is not named in the FIR and the allegation as per FIR is of recovery of pistol and explosive substance. Submission of the learned counsel for the petitioner is that except confession there is nothing against the petitionerT. Heard learned A.P.P. also.
Having heard both sides and in view of the facts and circumstances, as stated above, I am not inclined to grant
Patna High Court Cr.Misc. No.38733 of 2018 (2) dt.04-07-2018 2/2 anticipatory bail to the petitioner rather let the petitioner surrender before the learned court below within a period of four weeks from the date of receipt of the order and make prayer for regular bail, which will be considered by the learned court below on its own merit.
