JUSTICE VINOD KUMAR SINHA ORAL ORDER 04-11-2019 Petitioner seeks bail in anticipation of his arrest in connection with Complaint Case No. 1286 of 2017 instituted for the offences punishable under Sections 498A, 323 of the Indian Penal Code and Sections 3/4 of Dowry Prohibition Act. As per complaint petition petitioner happens to be husband of the complainant and there is allegation against him that he tortured the complainant with respect to demand and deserted her.
Submission of learned counsel for the petitioner is that the impugned order itself shows that she is second wife of the petitioner and earlier she married with another person and
Patna High Court CR. MISC. No.51826 of 2019(3) dt.04-11-2019 2/2 she is still residing with that person. Further submission is that he is still ready to keep her with dignity and care. Heard learned APP and learned counsel for opposite party No.2, who has submitted that she is ready to reside with the petitioner if she is allowed to live with dignity and care. In view of above stand of the parties, this application is disposed of with direction to the petitioner to surrender on 15.11.2019, on that day opposite party No.2 shall also remain present in the court and if petitioner is ready to keep her with dignity and care and opposite party No.2 is also ready to reside with the petitioner, petitioner shall be released on bail to the satisfaction to the court below with condition that petitioner has to keep the complainant with him with dignity and care.
