The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 341/323/324/307/504/506 of the Indian Penal Code. Prosecution case is that the petitioner assaulted with 'garasa' to brother-in-law of the informant namely Mansoor Alam repeatedly causing injury on his right arm and chest. It is submitted by learned counsel for the petitioner that the injury report is not on record and for a petty dispute the accusation has been levelled. Moreover, a statement has been made in paragraph 3 of the petition that the petitioner has no criminal antecedent.
Considering that the injury has not been found to be
Patna High Court Cr.Misc. No.1719 of 2016 (2) dt.13-01-2016 2/2 grievous, it is a case for consideration of prayer for regular bail. Let the learned Court below consider the prayer for regular bail of the petitioner, if the petitioner surrenders within a period of six weeks in connection with Vaishali P.S. Case No.337/2015, pending before the learned CJM, Vaishali at Hajipur.
With the above observation, this application is, accordingly, disposed off.
