The petitioner apprehends his arrest in Complaint Case No. 3635 of 2012 registered under Section 498(A) of the Indian Penal Code and Section 3 of the Dowry Prohibition Act. The wife-complainant made allegation against the petitioner husband that he subjected her to physical and mental torture.
Learned counsel for the petitioner submits that the petitioner is ready to keep his wife. Prior to filing of the complaint petition, the petitioner had filed Matrimonial Case No. 348/12 for restitution of conjugal rights.
Considering the facts that the petitioner wanted to
Patna High Court Cr.Misc. No.32913 of 2014 (2) dt.06-02-2015 2/2 keep his wife and for that he already filed the aforesaid matrimonial case for restitution of conjugal rights and thereafter the complainant filed this complaint case, the above named petitioner, in the event of his arrest or surrender before the learned court below within a period of four weeks from the date of receipt / production of a copy of this order, is directed to be enlarged on bail on furnishing bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Sub Divisional Judicial Magistrate, Saran at Chapra in Complaint Case No. 3635 of 2012, Tr. No. 2244 of 2014, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
