NILU AGRAWAL ORAL ORDER 05-07-2017 Heard learned counsel for the petitioner and learned APP for the State.

Petitioner seeks bail in connection with Mejorganj (Suppi) P.S. Case No. 190/17 for offences punishable under Sections 272, 273 of the Indian Penal Code and 30(a) of the Bihar Prohibition and Excise Act, 2016.

The prosecution case is that the police received a secret information that some illicit liquor is being carried from Nepal and during raid they apprehended the petitioner and one Suraj Kumar Singh and from Khaki bag kept in the motorcycle 12.900 litres of Nepali sophy wine and foreign liquor were recovered in different bottles. Accordingly, a seizure-list was prepared.

Patna High Court Cr.Misc. No.29773 of 2017 (3) dt.05-07-2017 2/2 It has been submitted by the learned counsel for the petitioner that he is innocent and has falsely been implicated in the aforesaid case as nothing has been recovered from his conscious possession.

However, learned APP for the State opposes the prayer for bail.

Be that as it may, let petitioner, above named, be enlarged on bail on furnishing bail bond of Rs.10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of learned 2nd ADJ cum Special Judge (Excise Act), Sitamarhi, in connection with Mejorganj (Suppi) P.S. Case No. 190/17.
