JUSTICE ALOK KUMAR PANDEY ORAL JUDGMENT Date : 22-07-2025 In the instant writ petition, petitioner has prayed for the following relief (s) :- "For issuance of a writ of certiorari to quash the letter dated 12.7.2021 passed by Collector, Bhagalpur, under Bhu A Vad No.
40/2019-20 Under Panchat 10 and letter dated 3.6.2021 Vad No.39/2019 under Panchat 7 by which, land of the petitioner has been acquisited on very low price and also the writ of mandamus to direct the to direct the respondents to pay Rs.2,00000/- (two lacs) per decimal as Prescribed by the govt of Bihar and cost of this proceedings."
2. Learned counsel for the petitioner submits that the
Patna High Court CWJC No.19442 of 2021 dt.22-07-2025 2/3 land appertaining to P.S. No. 94, Khata No. 5, Survey Area No. 09, Khesra No. 122, area 0.0705 Acre situated in mauza Mirzapur is the raiyati land of the petitioner and his brothers. Learned counsel submits that by virtue of the letter dated 12.07.2021 passed by the Collector, Bhagapur in Bhu A Vad No. 40 of 2019-20 and letter dated 03.06.2021 in Vad No. 39 of 2019, the land of the petitioner has been acquired on very low price by the National Highway Authority of India for construction of road. Learned counsel submits that by virtue of the impugned notice as contained in Annexure-1 petitioner has been awarded a compensation amount of Rs. 16,41,945/- which is very low and compensation should be decided @ Rs. 2,00,000/- per decimal. After receiving the said notice, petitioner has represented his grievance before the District Land Acquisition Officer, Bhagalpur by way of representation dated 17.08.2021 (Annexure-2), but the said representation has not been decided up-till-now.
3. Learned counsel for the State submits that if petitioner files a fresh representation before the before the District Land Acquisition Officer, Bhagalpur, the same shall be looked into.
4. Considering the facts and circumstances of the case
Patna High Court CWJC No.19442 of 2021 dt.22-07-2025 3/3 and the arguments advanced on behalf of both the parties, the present writ petition is disposed of with liberty to petitioner to approach the competent authority for redressal of his grievance, which has been raised by the petitioner in the present writ petition, alongwith the relevant documents, within a period of four weeks from the date of receipt of a copy of this order. If such representation is filed within the stipulated period, the concerned authority is directed to consider and dispose of the representation of the petitioner after giving him due opportunity of hearing, in accordance with law, expeditiously within a reasonable period of time, without being prejudiced by the order of this Court.
