JUSTICE DINESH KUMAR SINGH ORAL ORDER 18-01-2016 Heard learned counsels for the petitioner and the State. The petitioner being cashier of Bihar Awami Cooperative Bank Limited is apprehending arrest in a case registered for the offences punishable under Sections 420 and 120B of the Indian Penal Code.

It is alleged that the accused persons came to the office of the informant and claimed that the informant has taken loan from the aforesaid bank. A notice was also sent to the informant though the informant claimed that he never took any loan. It is submitted by the learned counsel for the petitioner that the petitioner being cashier of the said bank was never made accused in the FIR. His name subsequently transpired. There is nothing on record to suggest that the petitioner went to demand

Patna High Court Cr.Misc. No.2622 of 2016 (2) dt.18-01-2016 2/2 any loan amount from the informant. Statement has been made in paragraph 3 of the petition that the petitioner has no criminal antecedent.

Considering the nature of accusation, let the above named petitioner be released on anticipatory bail in the event of arrest or surrender before the learned Court below within a period of twelve weeks from today on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned CJM, Patna in connection with Pirbahore P.S. Case No.76 of 2013 subject to the conditions as laid down under Section 438(2) Cr.P.C.
