====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 18-09-2024 Heard learned counsel for the petitioners and the State.

2. Petitioners apprehend arrest in a case registered for the offences punishable under Sections 341, 323, 325, 448, 379, 308, 504, 506/34 of the Indian Penal Code.

3. As per prosecution case, on 14.05.2024 at 9 AM, all the F.I.R. named accused persons including these petitioners entered house of informant and assaulted informant and her husband with lathi, danda as a result of which, both of them sustained injury. It is further alleged that the accused persons committed theft of Rs. 50,000/-, gold necklace and mangalsutra.

4. Learned counsel for the petitioners submits that

Patna High Court CR. MISC. No.58102 of 2024(2) dt.18-09-2024 2/2 allegation against petitioners is general and omnibus. It is further submitted that though there is allegation of assault by four persons but there is no injury report on record in support of the same. Rest of the allegations are super addition to make the case grave. Petitioners claim clean antecedent.

5. Learned A.P.P. for the State vehemently opposed the bail application.

Considering the general and omnibus allegation and clean antecedent, this anticipatory bail is allowed and it is ordered that let the above named petitioners in the event of their arrest/surrender before the court below within a period of eight weeks from today, be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of court of Sessions Judge-XI, Aurangabad in connection with Navinagar P. S. Case No. 141 of 2024, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure.
