The petitioners seek bail in a case registered under Sections 302, 201, 120(B) of the Indian Penal Code. Allegation is that the accused persons including the petitioners killed the sister of the informant by setting her on fire.
It has been submitted on behalf of the petitioners that the petitioners are in custody since 31.03.2019 and have got no criminal antecedent. Charge sheet has been submitted in this case. There is no allegation of tampering of witnesses alleged against the petitioners. The name of the petitioners has
Patna High Court CR. MISC. No.52879 of 2019(2) dt.23-08-2019 2/2 transpired merely on the basis of suspicion. Except for suspicion, there is no other substantive evidence to suggest the implication of the petitioners in the present case. There is no eye witness to the alleged occurrence.
On behalf of the State, it is submitted that the petitioners are named in the F.I.R.
Considering the aforesaid facts and circumstances, let the petitioners, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Sub Divisional Judicial Magistrate, Saran at Chapra in connection with Isuapur P.S. case No.48 of 2019.
