JUSTICE DINESH KUMAR SINGH ORAL ORDER 23-07-2015 Heard learned counsels for the petitioners and the State. The petitioners are apprehending arrest in a case registered for the offences punishable under Section 363/366 and 120B of the Indian Penal Code.

The accusation is of kidnapping the daughter of the informant.

It is submitted by the learned counsel for the petitioners that for the occurrence dated 20.02.2015 the FIR was lodged on 10.03.2015. It is submitted by the learned counsel for the petitioners that the victim girl has married with son of petitioner No.1, namely, Prince Kumar. It is further submitted by learned counsel for the petitioners that the victim girl has also given a written report to the Station House Officer, Rail PS Danapur and to Officer-in-charge Sarai PS in which she admitted that she married

Patna High Court Cr.Misc. No.28356 of 2015 (2) dt.23-07-2015 2/2 with Prince Kumar. It is submitted by learned counsel for the petitioners that petitioners are father and uncles of Prince Kumar and they undertake to produce the victim girl before the court below on 25.08.2015.

Considering the aforesaid facts, let the above named petitioner be released on provisional bail in the event of arrest or surrender before the learned Court below within a period of twelve weeks from today on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned CJM, Vaishali at Hajipur in connection with Sarai P.S. Case No. 41/2015 subject to the conditions as laid down under Section 438(2) Cr.P.C.

On production of the victim girl the court below shall record the statement of victim girl and if she admits that she married on her own volition with Prince Kumar then the provisional bail granted to the petitioners shall be confirmed by the learned court below.

If any application is being filed for providing security to the victim girl then the court below will issue appropriate direction for providing security to the girl. (Dinesh Kumar Singh, J) BKS/- U T
