The petitioner is accused in connection with Barachatty P.S. Case No. 91 of 2015, registered under Sections 18, 20 and 22 of the Narcotic Drugs and Psychotroic Substance Act. The accusation is that, in course of patrolling duty, plant of opium was found in the field of the petitioner containing 1 kg premature fruit of opium.
Learned counsel for the petitioner submits petitioner has falsely been implicated in this case mere on suspicion. It is further submitted that petitioner has no criminal antecedent and is in custody since 09.12.2016.
Having regard to the facts and the circumstances of
Patna High Court Cr.Misc. No.24679 of 2017 (3) dt.05-07-2017 the case and the recovery of premature fruit of opium, the petitioner above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Sessions Judge, Gaya, in connection with Barachatty P.S. Case No. 91 of 2015. Out of two sureties, one surety must be the close relative of the petitioner.
