JUSTICE DINESH KUMAR SINGH ORAL ORDER 20-01-2016 Heard learned counsel for the petitioner and the State. The petitioner is apprehending his arrest in a case registered for the offences punishable under Section 414 of the Indian Penal Code and Sections 25(1-B)a/26/35 of the Arms Act. The prosecution is that the police received information that some miscreants are going to commit offence. In the raid the vehicle was intercepted from which country made pistol was recovered. The driver who was apprehended disclosed his name as Vikash Kumar Pandey and named Prakash Kumar, Satish Kumar, Vikash Kumar and Pappu Choudhary, the petitioner who escaped from the place of occurrence.

It is submitted by the learned counsel for the petitioner that nothing has been recovered from the possession of the

Patna High Court Cr.Misc. No.3152 of 2016 (2) dt.20-01-2016 2/2 petitioner. The petitioner has got one case bearing Saraiya P.S. Case No. 317 of 2015 under Section 47 of the Excise Act. The aforesaid facts constitute ground for consideration of prayer for regular bail let the learned court below consider the prayer for regular bail of the petitioner if he surrenders within a period of six weeks in connection with Muzaffarpur Sadar P.S. Case No. 375 of 2015 pending in the court of learned Chief Judicial Magistrate, Muzaffarpur.
