JUSTICE VINOD KUMAR SINHA ORAL ORDER 23-08-2019 Petitioners seek bail in anticipation of their arrest in connection with Complaint Case No. 2563 of 2017, corresponding to Trial No. 2276 of 2019, registered for the offence punishable under Section 498A of the Indian Penal Code.
Allegation against the petitioners, who happen to be
Patna High Court CR. MISC. No.52659 of 2019(2) dt.23-08-2019 2/3 husband, his family members and one co-villager, is that complainant was tortured in various ways and ousted from the matrimonial house with respect to demand of Rs.1 lac, Laptop, Colour TV, etc.
Submission of learned counsel for the petitioners is that complainant opposite party No.2 has filed a Matrimonial Suit before the Family Court, Gopalganj under Section 13 of Hindu Marriage Act for divorce stating that her parents have solemnized her marriage with petitioner No.1without her consent and she has not accepted the same and there is no relationship between them as wife and husband (Annexure-2) and further petitioner has lodged a Sanha before police station Bhore with respect to the aforesaid fact and she is leaving the petitioner No.1 on her own as she wants to reside with Shravan Kumar @ Chotu Ram.

In view of above facts and circumstances, let petitioners, in the event of arrest or surrender, be released on bail on furnishing bail bonds of Rs.25,000/- (Rupees twenty five thousand) each with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate-XV, Gopalganj, in connection with Trial No. 2276 of 2019, arising

No.52659 of 2019(2) dt.23-08-2019 3/3 out of Complaint Case No. 2563 of 2017, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. and further condition is that one of the bailors of the petitioners shall be a local person having sufficient immoveable property within the jurisdiction of the court concerned.
