The petitioner seeks bail in Sachivalay P.S. Case No. 69 of 2017 registered under Sections 3 and 5 of the Immoral Traffic (Prevention) Act, 1956.
The petitioner along with another co-accused and a girl were apprehended from a guest house and they are said to be indulged in flesh trade.
It is submitted by learned counsel for the petitioner that the girl happens to be major. Her statement was recorded under Section 164 of the Code of Criminal Procedure and she stated that the petitioner has not committed anything wrong with her. Though she has stated that the petitioner has taken her to Patna in the said guest house and forced her to enter into flesh
Patna High Court Cr.Misc. No.34076 of 2017 (2) dt.20-07-2017 2/2 trade, but she has given the said statement to save her skin from her parents as she had herself left the village along with the petitioner out of her own sweet will. The petitioner has been languishing in custody since 25.05.2017.
Considering the facts aforesaid, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Patna in connection with Sachivalay P.S. Case No. 69 of 2017 (Prakash Chandra Jaiswal, J) Mishra/- U T
