Petitioner is in custody in connection with Excise Case No. 768 of 2019 for the offence under section 30(a) of the Bihar Prohibition and Excise Act.
Learned counsel for the petitioner submits that in the instant case there is recovery of total 40 liters of country made liquor. He further submits that petitioner is in custody since 13.7.2019.
Considering the fact that nothing was recovered from the possession of the petitioner, the Court is inclined to grant bail to the petitioner, let the petitioner, named above, be enlarged on bail on furnishing bail bond of Rs. 25,000/- (Twenty
Patna High Court CR. MISC. No.51901 of 2019(2) dt.22-08-2019 2/2 five thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-VII-cumSpecial Judge Excise, Aurangabad, in connection with Excise Case No. 768 of 2019 subject to the condition that petitioner shall deposit Rs. 25,000/- (Twenty Five Thousand) cash in the court below which shall be abide by final outcome of the pending criminal case i.e. in the event of acquittal the amount shall be refunded to the petitioner otherwise the amount shall be forfeited.
